FOR IMMIGRANT INVESTORS · HAMILTONHamilton

Invest in anew chapter.

EB-5 is an immigrant investor category built around a qualifying capital investment and required U.S. job creation. For an applicant based in Hamilton, the useful starting point is understanding the actual investment structure and the paper trail behind the invested funds. The standard current minimum is US$1,050,000, reduced to US$800,000 for qualifying targeted employment area or infrastructure investments; the reduced figure depends on the project's own qualifying characteristics, not investor preference. The investor must engage in management or policy formulation. A spouse and unmarried children under 21 may qualify as derivatives, subject to individual eligibility and age analysis. Approval produces two-year conditional permanent residence, with Form I-829 filed in the 90 days before the second anniversary to remove conditions. The case must still establish lawful source and path, qualifying at-risk capital and at least ten full-time jobs for qualifying U.S. workers. The central decision is whether the investor can document both sides of the case: qualifying capital placed at commercial risk and a credible path to the required jobs. An initial review yields a funds-origin-and-transfer chart, a project evidence map, and a family timing calendar. EB-5 does not end with petition approval: qualifying investment and job-creation conditions continue into conditional permanent residence, followed by the process to remove conditions. The financial decision and the immigration decision need independent scrutiny because neither proves the other.

IN THIS GUIDE · Review the immigration file and the investment risk on their own terms

01

Connect the investment to the required jobs

The program generally requires the creation of at least ten permanent full-time positions for qualifying U.S. workers, with different evidentiary approaches for a standalone enterprise versus a regional center arrangement. Ask specifically how the project intends to establish those jobs and what assumptions the job-creation methodology relies on. A project's marketing materials or a regional center designation are not themselves a guarantee of either immigration approval or financial performance. Identify whether the project relies on direct payroll evidence or a regional-center methodology, then ask precisely how ten permanent full-time qualifying positions will be shown. Put the job assumptions beside the business plan, budget, and timetable. A presentation can describe a goal without supplying the evidence needed to establish that the jobs are attributable to the investment.

02

Trace the lawful source of the capital

Document how the investor obtained the funds and how they moved to the investment, including any intermediate accounts. Hypothetical example: a Hamilton-based investor's capital originated from the sale of a business several years earlier and passed through more than one account before reaching the project. Retain the sale, ownership and transfer records rather than relying on a current account balance alone. Start the source record at the original lawful acquisition of every material amount, not at the account from which the wire is sent. Sale contracts, tax returns, gift instruments, loan terms, estate documents, and bank statements should form one chronological chain. A current balance is not a substitute for evidence explaining how the funds became available.

03

Assess the offering as a financial commitment first

Review how the capital will actually be deployed, the contractual terms, applicable fees and project-specific risks with independent financial and legal advisers, keeping that review separate from the immigration evidence itself. A promised safe return or a promised fast immigration outcome should not substitute for reading the actual offering documents. Treat offering review as a separate investment decision. Read deployment, repayment, fees, conflicts, security, and loss provisions with advisers appropriate to those questions, then determine what can truthfully be used as immigration evidence. No project can promise approval, return of capital, or a fixed immigration result simply because it is marketed to EB-5 investors.

04

Plan the immigration stages and the family's timing together

The process generally involves an investor petition, an immigrant visa or adjustment of status stage where available, and a later petition to remove conditions on residence, with visa availability affecting the overall pace. Bring each family member's age and status objectives into the review early, since filing a petition does not by itself freeze a child's age for Child Status Protection Act purposes. Build a family calendar around petition, visa-availability, admission or adjustment, and the later condition-removal stage. Include exact child birth dates and any status constraints. Conditional residence begins only after the relevant immigration stage is completed, not when the capital is first wired or the investor petition is filed.
