Can an E-2 investor's spouse work in the United States?

THE DIRECT ANSWER

A qualifying E-2 spouse is generally employment-authorized incident to status, though the individual's documentation still needs to be reviewed rather than assumed. Dependent children do not gain work authorization from E status alone.

Plan the household's actual activities

Record each family member's citizenship, relationship evidence, age and intended work or study plans. A spouse's ability to work is a separate question from the investor's ability to operate the enterprise, and a shared business plan does not automatically create identical permissions for everyone in the household. Trace funding first, analyze release and refund terms next, and then compare the operating plan with the investment.

Confirm each person’s status evidence and planned activity before the business begins operating. For family matters, record relationships, citizenships, ages, and each person's intended activity. The household must decide whether the business plan still works if a spouse's employment or a child's study plan requires a separate timing or documentation step.

Hypothetical example: A small-batch soap maker will operate the shop while a spouse seeks unrelated employment; the household must document each person’s planned activity separately.
