L-1B applies to a qualifying transfer for work in a specialized-knowledge capacity. A Hamilton-based file starts most usefully with a plain description of what the person actually knows about the company and how the U.S. assignment will use that knowledge. Seniority, a hard-to-fill role, or a general claim that the person is indispensable does not, on its own, establish this category. The employee also needs one continuous year of qualifying work abroad within the relevant three-year period, while the related foreign and U.S. entities must remain active. A client-site placement cannot be labour for hire and must remain controlled by the petitioner. L-1B time is generally limited to five years. The useful decision is whether the company can explain the employee's specialized knowledge in operational terms and demonstrate why the U.S. role needs that expertise. An initial review yields a knowledge inventory, an acquisition timeline, a corporate-relationship chart, and a work plan tied to actual U.S. needs. L-1B also requires one qualifying year abroad during the relevant three-year lookback, and its aggregate stay limit is generally five years; neither a difficult recruitment market nor a valued employee changes those conditions.

IN THIS GUIDE · Explain the specific knowledge, not just how long the employee has worked

01

Name the knowledge instead of asserting a reputation

The relevant standard concerns special knowledge of the company's product and its application in international markets, or an advanced level of knowledge of the company's processes and procedures. Describe that knowledge concretely and connect it to supporting evidence. It does not need to be labelled unique in every case, but the file must explain why it meets the applicable standard rather than simply stating a conclusion. Break the asserted knowledge into named products, internal methods, technical sequences, or market applications, then attach an example for each. The reviewer should be able to see what the employee knows and how that knowledge differs in degree or application from ordinary familiarity. Avoid labels such as indispensable unless the records demonstrate the underlying fact.

02

Show how the knowledge was acquired and applied

Gather training records, project history and examples of the employee's actual responsibilities. Hypothetical example: a Hamilton employee learned a particular internal process over several projects and has been asked to help introduce it to a U.S. team. Identify the specific training and assignments that support that account, keeping confidential material appropriately handled rather than omitted without explanation. Place training records, project assignments, performance material, and knowledgeable supervisor statements on a dated timeline. This shows how the individual acquired and applied the claimed knowledge. If confidential material is needed, prepare a clear non-proprietary explanation and a controlled exhibit rather than making an unsupported assertion that secrecy prevents any evidence.

03

Connect the knowledge to the U.S. assignment

Describe the actual work planned in the United States and how the claimed knowledge will be used there. If the employee will work at a client's site, disclose who controls and directs that work, since offsite placement rules require a clear picture of the actual arrangement. A client's request for a specific person is not itself evidence of specialized knowledge. Match each U.S. task to a specific component of the knowledge inventory and identify the worksite supervisor. Client-site work deserves special care because the actual control and purpose of the placement must be transparent. A customer's preference for a particular employee does not itself prove that the statutory standard is met.

04

Keep the underlying transfer conditions in view

The one-year qualifying foreign employment requirement and the qualifying relationship between the organizations still apply, the same as for other L categories. Preserve employment dates and ownership records. If the actual role looks primarily managerial or executive, review it as L-1A on its own facts rather than defaulting to L-1B as a catch-all label. Run the transfer fundamentals in parallel with the knowledge analysis: qualifying entities, the foreign employment year, the proposed capacity, and the requested period. This prevents a detailed technical narrative from obscuring a corporate or timing defect. If the role evolves into management, assess the new facts rather than treating L-1B as permanent shorthand.
