IN THIS GUIDE · Prove the controls firmware is company knowledge, and that the company still controls the work
Start with the L-1B eligibility and application overview
Define the knowledge in terms only this company can claim
General expertise in a widely used controller platform is not specialized knowledge. Knowledge of the company's own firmware, its fault-handling logic, its calibration routines for its own elevator legs, and the undocumented reasons behind design choices is. Write a description that a competitor's engineer could not honestly sign. Include how many people in the whole company hold this knowledge and how long it took the designer to acquire it, because both facts help distinguish specialized from ordinary.
Show acquisition through dated project records
Commissioning logs, firmware version histories with the designer's name on commits, training she delivered to other staff, warranty investigations she led, and engineering change notices she authored all prove the knowledge was gained through employment with the petitioner. Confidential details can be summarized rather than reproduced; USCIS needs to understand the nature and depth of the knowledge, not the source code.
Structure the customer-site placement correctly
An L-1B employee stationed primarily at an unaffiliated worksite is permitted only if the arrangement is not essentially labour for hire and the employee remains controlled and supervised principally by the petitioner. Commissioning the company's own equipment under a warranty or installation contract, with the Canadian or affiliate engineering manager assigning and reviewing the work, generally fits. A customer that directs the designer's daily tasks and treats her as its own staff does not. Put the supervision chain in the petition and in the customer contract. Hypothetical example: a precision-irrigation controls developer sends a specialist to a customer's site to correct sensor failures in the developer's proprietary system. The installation agreement, assignment emails, project reports and manager review notes should show that the affiliate assigns the work, evaluates it and remains responsible for the result. If the customer sets the schedule, substitutes its own tasks and treats the specialist as its staff, the placement may fail the control analysis even though the knowledge is genuine.
Confirm the affiliate is a qualifying organization
The U.S. distributor must be a parent, branch, subsidiary or affiliate of the Canadian manufacturer, established through ownership and control records, not a dealership agreement. An independent distributor that merely sells the company's conveyors cannot petition for its designer under L-1B, however close the commercial relationship. If no qualifying U.S. entity exists, the options are to create one under new-office rules or to look at a different category entirely.
